Britney Spears Ruled As “Lacking Capacity To Testify”

Britney Spears has been ruled as “lacking the capacity to testify”, and as such, won’t be required to take the stand in court for her conservatorship’s ongoing quest to obtain permanent restraining orders against former manager Sam Lutfi, attorney Jon Eardley, and her ex-beau and paparazzo, Adnan Ghalib.

“There was a finding of a judge of the Superior Court that she lacks the capacity to testify,” Los Angeles Superior Court Judge Akiva Bobb said, after hearing closing arguments Tuesday.

Bobb upheld the 14-month-old ruling that Spears isn’t mentally fit to make her own legal decisions, and said the temporary restraining orders against all three men were extended until April 28, when he will hear rebuttal arguments before making a final decision.

Eardley’s attorney, Roger Diamond, filed a motion on April 10 to compel Spears to testify before closing arguments were made, however, Spears was not in attendance at the courthouse today.

Diamond argued today that Spears had wanted Eardley to help extricate her from father Jamie’s control.

“Britney Spears is crying out for help,” Diamond said.
