Kelly Rutherford Settles Custody Dispute With Ex-Husband

Gossip Girl actress Kelly Rutherford has settled her custody battle with her ex-husband, businessman Daniel Giersch, with the pair agreeing to share joint legal and physical custody of their two children, Hermes, 2, and Helena, two months.
Rutherford filed for divorce when she was several months pregnant in January this year, following two years of marriage.
According to the settlement, Rutherford and Giersch will temporarily move from California to the Hamptons in New York to be with the children while the actress films Gossip Girl.
TMZ.com reports that both parents will also attend co-parenting counseling sessions.
The settlement follows a bitter custody battle that spilled over from the courts into the press. Three months ago, the pair fought in court over whether son Hermes should be potty-trained. At the time, when asked then if she and and her ex could have an amicable relationship, Rutherford told reporters, “I don’t see it.” Thankfully for the two children, the situation appears to have a turned a corner.
